ACCEPTANCE OF TERMS

These Terms of Use (the “Terms”) govern your access to and use of the website operated by BETTER BASICS ECO LIFESTYLE COMPANY INC., operating under the brand name MARIS DAE (collectively, “Maris Dae”, “Better Basics”, “Company”, “we”, “our” or “us”), including all content, functionality, products, services, educational materials, blogs, social media content and other materials made available through the website or associated platforms, including Instagram and other social media channels (collectively, the “Site” and “Materials”).

By accessing or using the Site, you acknowledge that you have read, understood and agree to be bound by these Terms and any applicable policies referenced herein, including our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Site.

We reserve the right to modify these Terms at any time without prior notice. Continued use of the Site following any updates constitutes acceptance of the revised Terms.

WELLNESS, EDUCATIONAL AND INFORMATIONAL DISCLAIMER

The content available on the Site, including blogs, articles, skincare information, wellness content, supplement information, educational materials, ingredient information, social media content, videos and related materials, is provided for general informational and educational purposes only.

The Site may include educational content created or contributed to by wellness professionals. Such content is intended solely for general education and informational purposes and does not constitute professional advice.

PRODUCT AND HEALTH DISCLAIMER

The Company makes no guarantees regarding outcomes, efficacy, skin results, wellness results or health improvements.

ALLERGIES AND SENSITIVITIES

Users are solely responsible for reviewing ingredient information and determining whether products are appropriate for their personal use.

The Company is not responsible for allergic reactions, sensitivities or adverse events resulting from use of products purchased through the Site or through third-party providers.

You should discontinue use immediately and consult a healthcare professional if irritation or adverse reactions occur.

WAVE MAKERS / PRODUCT TESTING PROGRAM

The Company may offer product testing, ambassador, sampling, educational or feedback programs, including programs referred to as “Wave Makers” (collectively, the “Programs”).

Participation in any Program is voluntary and subject to additional terms provided by the Company.

Participants acknowledge and agree that:

(a) products may contain active ingredients, botanicals, marine ingredients, fragrances or other ingredients that may cause irritation, sensitivities or allergic reactions;

(b) participants are solely responsible for reviewing ingredients and determining suitability for personal use;

(c) the Company does not guarantee specific skincare, wellness or cosmetic results;

(d) all testimonials, reviews, comments, photographs, videos, feedback, suggestions and other materials submitted to the Company may be used by the Company for marketing, advertising, product development and promotional purposes without compensation unless prohibited by law;

(e) by submitting content, participants grant the Company a worldwide, perpetual, irrevocable, royalty-free licence to use, reproduce, modify, publish, distribute and display such content in any media;

(f) participants shall comply with all applicable advertising and endorsement disclosure laws, including disclosure of gifted products, compensation or affiliate relationships where applicable;

(g) the Company may remove or reject content at its discretion; and

(h) participation in any Program does not create any employment, partnership, agency or contractor relationship with the Company.

E-COMMERCE AND THIRD-PARTY FULFILLMENT

Orders placed through the Site may be processed, fulfilled, shipped or managed through third-party service providers, manufacturers, logistics companies, payment processors or e-commerce platforms.

The Company is not responsible for delays, interruptions, shipping issues, inventory issues or errors caused by third-party providers.

Third-party payment processors and e-commerce providers may have their own terms, conditions and privacy policies, which you agree to review separately.

SOCIAL MEDIA

The Company may maintain social media accounts, including Instagram and other platforms.

Any content posted on social media is provided for general informational, educational and marketing purposes only and shall be subject to these Terms.

USER CONDUCT

You agree not to:

• use the Site for unlawful purposes;
• interfere with operation of the Site;
• attempt unauthorized access to systems or accounts;
• upload malicious code or harmful material;
• copy or exploit Site content without authorization;
• use the Site in a manner that could damage the reputation of the Company.

INTELLECTUAL PROPERTY

All content, materials and intellectual property available through the Site are owned by or licensed to the Company and are protected by copyright, trademark and other intellectual property laws.

This includes, without limitation:

• trademarks;
• product names;
• branding;
• educational materials;
• blogs;
• text;
• graphics;

• designs;
• formulations;
• product descriptions; and
• marketing materials.

No content from the Site may be copied, reproduced, distributed, modified, republished, transmitted, displayed or exploited without prior written consent from the Company.

No licence or ownership rights are granted to users except for limited personal, non-commercial use.

USER SUBMISSIONS

Any comments, feedback, testimonials, reviews, suggestions or submissions provided to the Company may be used by the Company without restriction or compensation unless prohibited by law.

You represent that any content submitted by you does not infringe the rights of third parties.

THIRD-PARTY LINKS

The Site may contain links to third-party websites, retailers, service providers or social media platforms.

The Company does not control and is not responsible for the content, policies, products or services of third parties.

GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

You irrevocably submit to the exclusive jurisdiction of the courts of British Columbia located in Vancouver, British Columbia with respect to any dispute arising from these Terms or use of the Site.

SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

WAIVER

Failure by the Company to enforce any provision of these Terms shall not constitute a waiver of any rights.

ENTIRE AGREEMENT

These Terms, together with any policies referenced herein, constitute the entire agreement between you and the Company regarding use of the Site.
